Andrew Reineke sentenced to 50 years in Commerce City neighbor’s shooting death

The Commerce City man who pleaded guilty to second-degree murder and attempted murder in the 2021 shooting death of his neighbor was sentenced to 50 years in prison Friday, according to court records and the 17th Judicial District Attorney’s Office.

Andrew Reineke, 30, was sentenced to 30 years in the Colorado Department of Corrections for second-degree murder and 20 years for second-degree attempted murder in Adams County District Court on Friday. The sentences will run consecutively.

Reineke pleaded guilty to the lesser charges on Sept. 20 in a plea agreement with the district attorney’s office. He was initially charged with first-degree murder, attempted first-degree murder, first-degree assault on a peace officer and felony menacing.

According to the district attorney’s office, Reineke confronted his 65-year-old neighbor, Andrew Ervin, on Aug. 3, 2021, near their homes on Grape Street and shot him in the back 11 times.

Reineke fled the area and shot at responding Commerce City police officers and an Adams County sheriff’s deputy, according to the district attorney’s office. One of the bullets passed through an officer’s sleeve, and others hit a police vehicle.

The officers returned fire, and Reineke was shot in his arms and legs and arrested in the 6900 block of Fairfax Drive.

The officers involved in the shooting were cleared of criminal wrongdoing in a June 2022 decision letter by District Attorney Brian Mason.

“This was a horrific crime with devastating consequences,” Mason said in a statement Friday. “The defendant murdered a neighbor, shot at multiple police officers, and put countless lives in danger. I commend the heroic actions of the law enforcement officers who responded to this dangerous scene. The defendant will now have 50 years in prison to consider his egregious actions.”
